These Terms of Service ("Terms") govern your use of the ChatClick website at chatclick.ca and the websites, hosting, and AI chat agent services we provide (together, the "Service"). The Service is operated by ChatClick, a sole proprietorship registered in Hamilton, Ontario, Canada (Business Number 709629836TZ0001) ("ChatClick", "we", "us"). By using the Service or signing up as a client, you agree to these Terms.
1. The service
ChatClick builds and hosts a fast, secure one-page website with our own onboard 24/7 booking agent that answers visitors, qualifies them, and books them for your business, replying in both English and French. The service includes the website, hosting, SSL and your domain pointing, the booking agent trained on the information you provide, booking integration, Google Business Profile setup, lead notifications by text and email, one round of content updates a month, and a monthly performance summary. Optional add-ons (such as extra pages, content refreshes, or ad management) are quoted separately before any work begins.
2. Fees and payment
The price is $0 CAD setup plus $99 CAD per month, month to month, with no deposit. You review a free demo of your site first, then start the $99 CAD monthly subscription to go live. Add-on pricing is provided in writing before any work begins. The monthly fee begins when your site is launched and recurs monthly until cancelled.
Prices are quoted in Canadian dollars and payments are processed securely through Stripe, our third-party payment provider. Fees are exclusive of any applicable taxes, which will be added where required. Late or failed payments may result in suspension of the Service after notice.
3. Term, renewal, and cancellation
The plan is month to month. It renews automatically each month until you cancel. You can cancel at any time by email, with no contract and no cancellation fee. Because the site is a hosted service (see section 6), it stops running when your subscription ends: on cancellation the site goes offline. You keep your own domain. We offer a 30-day money-back guarantee: if you are not happy within 30 days of your site going live, email us and we will refund the monthly fees you have paid. After that 30-day window, monthly fees already paid are not refundable.
4. Your responsibilities
You agree to provide accurate business information and content, to hold the rights to any material you give us to publish, and to use the Service lawfully. You are responsible for reviewing the content of your site and for the conduct of your business with the leads and customers the Service helps you reach. Acceptable use of the Service is described in our Acceptable Use Policy and SLA.
5. The booking agent
The booking agent is our own and is built on a third-party large language model, trained on the information you provide. It is designed to escalate to a human when it is unsure, but like any automated system it can make mistakes or produce incorrect answers. It does not provide professional, legal, medical, or financial advice. You are responsible for the information you ask us to load into the agent and for reviewing how it represents your business. We are not liable for decisions you or your customers make based solely on the agent's output.
6. Hosting, ownership, and what happens on cancellation
ChatClick is a hosted subscription, not a one-time build. We host and maintain your website and booking agent as part of the $99 CAD per month. You do not receive the source files and you do not own the website files. You own the content and brand assets you provide to us, and you keep your own domain. We retain ownership of the website we build, our underlying platform, code, templates, and the booking agent infrastructure.
Because the website is a hosted service that we run for you, it stops running when your subscription stops. If you cancel, the site goes offline and is no longer served. We do not hand off the source files. You can keep your own domain and point it to a new provider.
7. Service availability
We aim for high availability and rely on reputable infrastructure, but we do not guarantee that the Service will be uninterrupted or error-free. Planned maintenance, third-party outages, and events beyond our control may affect availability. Our service targets and support commitments are described in the SLA.
8. Disclaimers and limitation of liability
The Service is provided "as is" and "as available", without warranties of any kind except those that cannot be excluded by law. We do not warrant any specific number of leads, bookings, or business results. To the maximum extent permitted by law, our total liability for any claim arising out of or relating to the Service is limited to the amount you paid us for the Service in the three months before the event giving rise to the claim. We are not liable for indirect, incidental, or consequential damages.
9. Indemnity
You agree to indemnify and hold harmless ChatClick from claims arising out of the content you provide, your use of the Service, or your dealings with your own customers and leads.
10. Governing law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-law rules, and you agree to the courts of Ontario as the venue for disputes, except where mandatory consumer-protection law provides otherwise. Nothing in these Terms limits rights you may have under the laws that apply to you.
11. Changes to these terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and, for material changes affecting active clients, give reasonable notice by email.
